Process and Delivery

1. Inquiry: Fill out the Commission Form, or Commission me through VGen.
コミッションフォームにご記入いただくか、VGenを通じてご依頼ください。


2. Agreement: I will review your request within 24 hours. After that, I will send you a tailored proposal with the invoice.
24時間以内にご依頼内容を確認させていただきます。その後、請求書をお送りします。


3. Payment: I will send you an invoice via PayPal or Stripe(ko-fi). Once paid, I start working on your commission according to the agreed date. Failure to pay within 48 hours will result in the cancellation of your request.
PayPal または Stripe(ko-fi) で請求書をお送りします。お支払いが完了しましたら、お約束の期日までに制作に取り掛かります。
48時間以内にお支払いいただけない場合、お申し込みはキャンセルとなります。


4. Notice: I will contact you via requested mode of contact when I begin working on your request, starting the Expected Turnaround Time (ETAT).
あなたのリクエストに取り組み始めたら連絡します。


5. Drafting: You will receive 1 draft. (Includes rough sketch, colour, shading, lighting, and effects)

6. Revisions: After reviewing the draft, you may request revisions. Max 4, including free revisions.
ラフ案を確認後、修正を依頼することができます。無料修正を含めて最大4つまで。


7. The ETAT will be paused when the drafts and revisions are sent to you for approval. The ETAT will resume upon receipt of your response, whether for revisions or final approval.
ラフ案と修正案が承認のためにあなたに送られると、所要時間は一時停止されます。所要時間は、修正であれ最終承認であれ、あなたの返答を受け取った時点で再開されます。


8. Draft approval: After approval of the revisions, I start finishing the work.
修正が承認された後、私は仕上げに取り掛かる。


9. Finish: Upon completion, artworks will be delivered via requested platform or through the used commissioning platforms.
作品は完成後、電子メールまたは使用するコミッション・プラットフォームを通じて納品される。


10. You may still request minor tweaks.

⟡ Deliverables(納品形式): PNG, JPG⟡ Source files (CSP/PSD), will only be provided for Commercial Use Licence B.

   ⟡ Commercial use 商用利用: Max B1(707mm x 1000mm) / JIS B1(728mm x 1030mm). Due to hardware restrictions, for large pieces like B1/B2/A1/A2, the max DPI possible is 200. Otherwise it can be 350DPI.


⟡ In cases where the file size exceeds attachment limits, the deliverables will be provided via Google Drive.

Terms of Service

Last Updated: June 11, 2024MilkyLewky's Terms of ServiceBy commissioning me, you would agree to adhere to the following terms and conditions. Non-compliance may result in cancellation of your commission.

I. GENERALa. The Terms of Service (ToS) and pricing are subjected to change without prior notice. You are bound by the ToS and pricing in effect at the time of your commission request submission.b. For commission requests submitted through third-party commissioning platforms, such as VGen, the ToS given in the respective platform will apply before the ToS here.c. I reserve the right to decline or cancel any commission at my discretion.d. The commission will only commence once both parties, MilkyLewky (the artist) and the client, have agreed on the specifications and payment.e. The Expected Turnaround Time (ETAT) for the commission will be mutually established before work begins.f. You are of age 18 and above when commissioning my R-18 services.g. I explicitly refuse to grant permission for the use of my artwork in any capacity related to AI training or NFTs.

II. PAYMENT & FEESa. Full or half payment is required upfront.b. For half payments, 50% shall be paid upfront before I start your request, and the last 50% shall be paid upfront before I finish your request after you approve the draft.c. Payments should only be sent after the commission has been accepted and payment requested by the artist.d. Payments are only to be made via VGen or PayPal.e. A rush fee applies for commissions with expedited deadlines. Rush fees will be charged at 50% of the total price.f. Additional fees for extensive or significant revisions are detailed in the “Revisions” section.g. Any new requests not included in the initial agreement require upfront payment before proceeding.

III. SCOPE OF WORKa. The client is responsible for providing a detailed description, including inspiration images or visual aids, for the commission.b. All necessary materials and specifications must be provided with the commission request.c. NSFW or R-18 content requests involving children, characters resembling children (e.g., loli, chibi), or real individuals (e.g., VTubers, YouTubers, celebrities, real people, etc.) are prohibited.d. Requests promoting malice toward any race, religion, or political figure are strictly prohibited.e. Requests that incite discrimination in any form will not be accepted.

IV. PROCESS AND DELIVERY (Skeb Style/Sketches Services will not have drafts and free revisions)a. Inquiry: Fill out the Commission Form or Commission me through VGen, or DM me using the "DM Request" Template given.b. Agreement: I will review your request ASAP. After that, I will send you a tailored proposal with the invoice.c. Payment: I will send you an invoice via PayPal or Stripe(ko-fi). Once paid, I start working on your commission according to the agreed date. Commissions through VGen will be payed through VGen. Failure to pay within 48 hours will result in the cancellation of your request.d. Notice: I will contact you via requested mode of contact when I begin working on your request, starting the Expected Turnaround Time (ETAT).e. Drafting: You will receive 1 draft. (Includes rough sketch, colour, shading, lighting, and effects)f. Revisions: After reviewing the draft, you may request revisions.g. The ETAT will be paused when the drafts and revisions are sent to you for approval. The ETAT will resume upon receipt of your response, whether for revisions or final approval.h. Delays in response or feedback from the client that affect the delivery date will be the responsibility of the client.i. Draft approval: After approval of the revisions, I start finishing the work.j. Finish: Upon completion, artworks will be delivered via requested platform or through the used commissioning platforms.k. You may still request minor tweaks (Read section "V. REVISIONS, g.")

V. REVISIONSa. Please note, that overhauling of initially agreed-upon requests no longer counts as a revision. Such requests will not be accepted. (E.g. If the pose initially requested was sitting on a chair, it cannot be changed to standing/lying down/swimming/etc. Or if the outfit initially requested was a maid costume, it cannot be changed to a butler/bikini/onesie/etc.)b. Categories for revisions: Composition, Parts of the Poses, Facial expression, Hairstyle, Parts of the Outfit, Colours, Background Design, and Effects.c. Two free rounds of revisions are included with each commission plan. A maximum of 4 rounds of revisions may be requested (free revisions included).d. Revisions are only available before the approval of the draft.e. Each additional revision will be charged a fee 20% of the commission's base price.f. For each revision requested, the ETAT will be extended.g. Once the draft has been chosen and approved, no further revisions shall be made. *Minor tweaks like colour correction, contrast correction, and changes to fonts, can still be made and will be free of charge.g. Additional requests not included in the initial commission require upfront payment.

VI. COMMUNICATIONa. Via chosen form of contact.
b. Communication should only involve related requests. Questions that invade my privacy will not be entertained.

VII. DEADLINEa. Completion times are subjected to my current workload and will vary based on the plans requested. Delays will be communicated promptly.b. Final Delivery may be made within 1-4 weeks after I start on your request. Generally, it should not take longer than 30 days to complete your request.c. The commencement of work will start the agreed-upon Expected Turnaround Time (ETAT).d. I will endeavor to meet the agreed deadline, barring delays caused by the client's response time during the approval stage.

VIII. FILESa. Image files will be in high-resolution formats, specifically in .png and .jpg files.b. Source files, such as .csp or .psd files, will be included in the final delivery package only if the Commercial Use Licence has been purchased by the client.c. In cases where the file size exceeds attachment limits, the deliverables will be provided via Google Drive.d. The client is responsible for backing up the commissioned work. I will not be liable for data loss.e. Resend requests can be made with proof of purchase, though I cannot guarantee indefinite data retention.f. Size & Resolution for Illustrations:
_   ⟡ Personal use: Max 4096px x 4096px, 350DPI
_   ⟡ Commercial use: Max B1(707mm x 1000mm) / JIS B1(728mm x 1030mm). Due to hardware restrictions, for large pieces like B1/B2/A1/A2, the max DPI possible is 200. Otherwise it can be 350DPI.

IX. PERSONAL USAGE POLICYa. Commissioned artwork is for personal use only.b. The commissioned artist must be credited when the commissioned artwork is displayed in any public, private, or online setting.c. Any reproduction or purpose that is marketed, promoted, or sold and incorporates a financial transaction with the commissioned artwork, is NOT ALLOWED.d. Characters within the artwork may be claimed as your own, but not the artwork itself.e. The artwork may not be altered or edited by anyone other than the artist unless the Commercial Use Licence or both the Commercial Use Licence and Copyright are acquired.f. My signature must not be removed from any artwork unless the appropriate licence(s) have been purchased. (It will be placed in a spot that will not ruin the artwork)

X. COMMERCIAL USAGE POLICYa. Commercial Use Licence A: For streaming and content use, the price is 1.5x the base price.b. Commercial Use Licence B: For merchandise, ads, prints, and other forms of reproductions with financial transactions, the price will be 3x the base price.c. The commissioned artist must be credited when the commissioned artwork is displayed in any public, private, or online setting.d. The commissioned artwork may be altered and edited.d. I still own the Copyright to the commissioned artwork.e. The source files for the commissioned requests will be provided once the Commercial Use Licence has been purchased.

XI. INTELLECTUAL PROPERTY RIGHTSa. All rights are reserved with me until Copyright is purchased.b. Copyright ownership of the commissioned artwork remains with me until purchased by the client.c. Copyright purchase of one commissioned artwork is 0.5x the base price and excludes the price of commercial use. However, Commercial Use Licence B of that one artwork has to be purchased first before the Copyright for that one artwork may be acquired.d. I do not and will not consent to any of my artworks to be used for training artificial intelligence systems or for creating non-fungible tokens (NFTs). I do not and will not consent to any other forms of distribution that tarnishes, alters, distorts, or mutilates my works and my name, MilkyLewky.

XII. REFUND AND CANCELLATION POLICYa. NO refunds, except where the artist fails to deliver within the agreed Expected Turnaround Time (ETAT) due to reasons not attributed to the client.b. Refunds are issued minus any transaction fees (PayPal).c. For commissions via platforms (VGen), their respective ToS will dictate refund and cancellation policies.d. I reserve the right to cancel any commission and will refund the appropriate amount under such circumstances.
